PRIVACY POLICY UNDER ART. 13 REGARDING PERSONAL DATA PROTECTION APPLIED BY LEGISLATIVE DECREE 30 JUNE 2003, N. 196

Eme S.r.l., hereafter referred to as Company, under article 13 of the Code regarding personal data protection by Legislative Decree on 30 June 2003, n. 196, hereafter referred to as “Code”, which sets out provisions for the protection of people and other subjects as regards the processing of personal data that it is willing to process, provides the e-mail information service user, hereafter referred to as “the person concerned”, with the following policy.

1. Purposes of the processing of personal data

Personal data collected will be processed, stored and filed by the Company for the following purposes:

  1. Purposes connected to the organization of promotions and offers required by the Company, thus to all of its related services;
  2. Purposes connected to the verification of all services provided by the Company, including customer care;
  3. Purposes connected to commercial promotion of the development of new services, to the product offer and/or to the possibility to obtain particularly advantageous conditions, also through third parties, as well as in the communication with companies specialized in commercial promotion or in order to verify the satisfaction level of the concerned person regarding the services provided by the Company. The processing connected to said purposes requires the consent of the concerned person and without said consent, it will not be possible to send information or advertising material, or to assess the satisfaction level of the concerned person as regards the service provided.

2. Data processing methods

As regards the purposes mentioned, the processing of personal data by the Company is carried out using manual and computerized instruments, set out according to the purposes themselves and, however, in order to guarantee data security and confidentiality. The storage of personal data is carried out using both electronic and computerized instruments, and also using specific paper archives.

3. Subjects to whom personal data can be disclosed, as they are responsible for the processing

3.1. Personal data collected can be disclosed, without the consent of the concerned person, in compliance with the duties within the legal provisions, to the following subjects.

3.2. Personal data collected can also be disclosed to those subjects who perform activities that are connected to the services in the website and to the performance of the Company’s activities. Otherwise, they can be known as the people in charge of the data processing. Moreover, the people involved in the following activities are also part of said category:

– hosting services;

– storage of personal data from documents or supports provided by the Users.

3.3. Personal data can be disclosed to third companies, specialized in marketing, promotion and information activities, as well as in the assessment of the quality of the services provided by the Company, that signed business agreements with the Company itself.

Lack of consent for communication to the above mentioned subjects from the concerned person, in some cases, could lead to the actual impossibility from the Company to provide the commercial services required.

3.4. Some categories of subjects, as responsible for the processing, will be able to access the data of the concerned person, in order to perform the tasks and duties allocated to them. Particularly, the Company instructed or can instruct its employees to process the data, as well as their collaborators and consultants. Likewise, subjects that the Company indicates as responsible for the processing, according to the tasks allocated to them, can be made aware of the data of the concerned person.

3.5. Personal data can also be disclosed to the Company’s subsidiaries or to companies that belong to the same group of the Company.

3.6. The Company will not disclose its own processed personal data.

The concerned person, at any time, can demand the Company to give him/her information about the business name or the corporate name of the subjects, to which the Company will disclose personal data of his/her concern.

4. Rights of the concerned person.

Article 7 of the Code confers specific rights to the concerned person, some of which are listed below:

-obtain the confirmation of the existence of personal data about him/her from the owner and their availability;

– get to know the origin of such data, as well as the aims of the processing;

– cancel, render anonymous, or to block the data processed against the law, as well as the updating, the modification or the integration of data;

– refuse the processing itself for legitimate reasons.

The rights mentioned in this paragraph can be exercised with an informal demand to the Owner or to the responsible by sending it to the address of the Company’s main office by registered letter, e-mail or fax. As far as the rights mentioned in the article 7, paragraphs 1 and 2 of the Code, said demand can be also communicated orally.

For each demand of confirmation about the existence of personal data, the concerned person may, if said data do not exist, be charged with a fee, which must not exceed the actual costs incurred by the Company, according to the dispositions and within the limitation defined by the Supervisor of personal data protection.

TYPES OF DATA PROCESSED

Navigation data
